Serious HOA Irregularity
The Summit HOA is due to elect three Directors to the Board on November 1, 2022, and the Nominating Committee should be hard at work. Last week I became aware of a serious irregularity in the nominations process that the Committee is supposed to follow.
The closing date for applications for the board was Friday, October 7, and I submitted an application on October 5. The Committee met on October 13, and on October 14 I received a rejection letter from the Committee "on behalf of the Summit Board of Directors".
The problem is that the Committee never received my application from the office!
On October 21 I emailed the HOA's attorney and requested assurance of the integrity of the nominations process. I am considering legal action to stop the election, if I don't get that assurance by October 27th.
The guidelines for the Committee are crystal-clear in the Procedures Reference Manual (PRM). No member of the Board (except the chair of the Nominations Committee, who is a board member) is to be involved in the nominations process. In the PRM see Art. III, Section H (Pages 22-24).
Today I received this email from the chair of the Safety Committee:
"On 10-21-2022, you sent an email to the Summit Homeowners Association that you are considering legal action against us. Due to this notification, I am rescinding your invitation to attend all Safety Committee meetings and events.
"Once this situation is concluded, I will be open to the possibility of you being allowed to attend safety meetings and events."
What does this sound like to you?
Your Summit HOA does not like to be questioned about non-compliance with the CC&Rs, By-Laws and PRM.
If 2,470 homeowners (out of the 2,480) were paying attention to how your HOA is being directed and managed, they would shake up their Voting Members (VM) and insist that they pressure the Board to comply with the By-Laws. If the VMs didn't act on their behalf, they'd replace the VMs at the next annual Neighborhood Meeting.
Oh, wait; that too is a big problem. The 28 Neighborhoods don't have annual meetings (as required in the By-Laws).
