Danny Trapp's Affidavit in Court Case Against Gus
As part of the HOA's lawsuit against Gus Philpott (me), the HOA's President, Danny Trapp, gave a sworn Affidavit to the HOA's lawyer on December 30, 2024.
His Affidavit is a public document, on file with the Richland County Court of Common Pleas for the Fifth Judicial District.
Danny's Affidavit is reproduced here. Formatting changed when it was opened in Google Docs, so that it could be copied and pasted here. No alterations have been made. Nothing has been added or deleted. Page 3, the signature page, is not included.
I shall elaborate on certain accusations in a separate article on this blog.

Personally appeared before me Danny Trapp, who, first being duly sworn on oath, deposes
and says:
1. My name is Danny Trapp. Unless otherwise stated, I have personal knowledge of
the information stated herein.

I am the owner of real property in a subdivision referred to as The Summit, located
in Richland County, South Carolina.

I am a member of the Summit Community Association (hereinafter, the
"Association") and currently serve as President of the Board of Directors for the Association.

I was elected President of the Board in November of 2023.
Through my membership in the Association and my service on the Board of
Directors, I am familiar with the By-Laws of the Association and the Declaration of Covenants,
Conditions and Restrictions for the Summit.

Per the terms of the By-Laws and the Declarations, only property owners are
entitled to the rights and privileges of Members of the Association.

Upon information and belief, Mr. Philpott is not a property owner.

Despite this, he routinely appears at Association meetings.

He is the only non-property owner who attends such meetings.
In my time as President, Mr. Philpott has been at every Association meeting and
routinely behaved in a disruptive manner.
11. Mr. Philpott regularly demands information that he is not entitled to, and makes
false accusations about the legitimacy of the Board and its actions.

On one occasion, Mr. Philpott said that he was going to "come after" me, when I
did not give in to his demands.

At a board meeting in November of 2024, Mr. Philpott wanted me to tell him who
was going to be elected to the new Board. When I did not divulge this information, he said "I'll
see you in court."

It is my observation that Mr. Philpott attempts to incite other residents and stir up

Association and Board Members and volunteers about their interactions at Gus Philpott.

I have received numerous reports of Mr. Philpott visiting the Property Manager's
office and demanding information from the people who work there.

Multiple people have expressed to me that they are afraid of Mr. Philpott.
Mr. Philpott's behavior has disrupted the functioning of the Association and the
Board, and it is my personal belief that the behavior will only continue to escalate if left unchecked.
