Shooting can't happen at our HOA

A shooting killed five at a Toronto condo board meeting on December 18. www.foxnews.com/world/gunman-opens-fire-toronto-condo-board-killing-five-second-such-shooting-a-week Rest assured that that will never happen at a Summit HOA board meeting. Why not? Because board meetings are off-limits for weapons. They are Gun-Free Zones. Everyone knows that a criminal will not enter gun-free zone; right? Does that make you feel better? Safer? Well, at least board members, committee members, contractors and HOA employees cannot be armed, according to the Procedures Reference Manual (Art. II, D, 1)). There doesn't seem to be any prohibition against legally-armed residents or homeowners showing up who could defend board members. Should the PRM be changed? Of course!

Careless Mistakes in CAMS Reports - Why Tolerated?

Why does the Board of Directors and in particular, the President and Treasurer, tolerate the simple errors that exist in the financial reports? Could it be that they don't even look at the financial reports? Or, if they do, that they don't understand them? Example: On Page 19 on the Minutes of the December 6, 2022 board meeting, there is a chart labeled "OERATING". It is in the section titled "Operating Expenses/Expense Statement". (OPERATING was spelled correctly in the previous month's Minutes.) A line explains "The Association continues to operate in accordance with the approved budget, except for the significant variances this current monthly budget, which are as follows:" For Parkway Lights, it's easy to see that the Variance is wrong. The Actual was $24 less than Budget. The chart is misleading by showing YTD. And last month the same Budget and Actual numbers produced a larger variance. A Glowing Financial Report - Seriously?

You won't want to miss the Minutes of the December 6, 2022 HOA board meeting! Do you know where to find them? Go to www.summithomeowners.com . Then hover over RES,IDENTs and click on DOCUMENTS. Then click on Board of Director's Minutes. Then click on December 2022. The first worthless report of the Finance Committee you'll come to reads "The committee researched CD rates for CD's [ sic ] that are maturing. The monies being spent on projects have been previously allocated." That tells you a lot, doesn't it? Continuing scrolling down to Page 19, "Financial Summary and Variance Report" for 10 months (through October 2022). I've been questioning for months why the HOA has so much money in Operating Accounts. How about $634,144.53 ($64,366.46 + $1,001.34 + $323,557.66 + $245,219.07)? No one seems to think there is any problem with earning on 0.01% on $232,038.06 in one Reserves account. Look at Page 20 and the interest rates being earned on large ...

If you tripped on a wire ...

 ... across a sidewalk, fell, smashed your face, broke a wrist or arm, or hurt your shoulder or back, whom would you sue? The homeowner? The HOA? The County? AT&T? In my neighborhood, when AT&T laid cable for a fiber-optic upgrade, it strung a cable across a sidewalk in two places. It didn't tape it down or cover it with any kind of mat. Anyone walking along could easily catch one of the wires with his toe and fall head-first onto the cement sidewalk. On November 20 I emailed the Summit HOA's office and suggested they contact AT&T and request that the wire be secured and pedestrians protected. There was no acknowledgement or reply. Today I emailed the board and asked them to ask the office to take care of it. I also asked if there was a reason that the office had not replied to me. " On June 6, 2020 I was tossed into Twitter Jail for tweeting to Michael Smerconish during his Saturday show on protests in Spokane and Portland.  What was my offensive tweet? $2,000,000 gone from Florida HOA

Did you see the FoxNews article about the $2,000,000 gone from a Florida HOA and the arrests of five people? I have urged the Summit's board of directors to conduct a forensic audit of the HOA's financials, but they refuse to do so. I'm not the only one who thinks this would be a good idea. George Reynolds was the long-time Treasurer of the HOA who died in office in February 2021. That event should have triggered a forensic audit. Then, in 2021, the HOA had three treasurers. Reynolds (Jan.-Apr.); Paul Hill (May - Nov.); Vernell Butler (Dec. - present). Three treasurers in one year ought to trigger a forensic audit. I am contacting the District 79 State Representative, Ivory Thigpen, this week to discuss his proposing new legislation that will give the State of South Carolina the authority to investigate HOAs that do not comply with their By-Laws. Have you examined the 2023 Budget yet?

All Summit HOA homeowners should examine the 2023 Budget. One of the glaring errors in the 2021 and 2022 Budgets has been fixed - sort of. But it's still not right. Can you spot it? Here goes: Total Assessment Income is $1,262,250. The same as in 2022 and 2021. At first glance, that is as it should be. Dues have not gone up. BUT the number of homes has changed. On April 8, 2022 I learned from the CAMS office that there are 2,480 homes in The Summit. (I had asked because Treasurer Vernell Butler had told the board that there were 2,800 homes.) How much should the dues income be? 2,480 x $510 = $1,264,800. $1,262,250 / $510 = 2,475 homes. Is income from five homes missing? The HOA receives money from fines for Violations. Why are fines in 2023 expected to increase 121% ? Line Item 4600 was increased from $28,000 to $62,000! Grab your wallets, folks! Last year Line Item 6500, $140,000, was under Salaries. 2023 Budget - See the HOA website

Curious about the 2023 Budget that was approved by the HOA board of directors on November 1, 2022? It's on the website, in the Homeowner section (password-protected). Click on RESIDENTS, then on DOCUMENTS. Then click on Annual Budgets, then on 2023. After two years of my barking, the HOA finally did away with the category of "Salaries". Imagine that. The only problem with Salaries was that the HOA had NO employees. Increase the size of the spreadsheet, so that you don't go blind trying to read the numbers. Now, what's wrong? Even though rampant inflation has spread across the U.S. and South Carolina, the top line hasn't changed. It's still $1,262,250. Of course, it is fixed at that amount because of the dues (called regime fees by the old-timers). 2480 homes at $550 = $1,264,800 Why does the top line (gross dues income) show $1,262,250 and not $1,264,800? Board Election misses November Scoop

What a shame that the November 2022 Summit Scoop did not include the results of the November 1st election of Directors. If the Board of Directors took any interest in the content of the Scoop, they would have directed inclusion of the election results. The same old stale list of Directors was published. Only one name would have changed, but it's important. Vicky McCarthy was elected to the board. Dennis Rybicki was elected (not "re-elected"). Vernell Butler was re-elected. Auby Dellinger was not re-elected. Vernell Butler too quickly announced at the November board meeting that (new) directors are seated in January. At the time I wondered where he got that. Vernell was wrong. Flat wrong. The By-Laws don't come anywhere close to saying that newly-elected directors are seated in January. HOA Board Disregards By-Laws

Here is a copy of my email to the HOA board this evening, following the monthly board meeting on November 1.  Good evening, board members, When does the term start for newly-elected board members?  It starts upon election. Vicky should have joined the board immediately at the November 1st board meeting.  Please note in the By-Laws,  Art, III, A, Section 6 (c) ¶2.  "The directors elected by the Voting Members shall hold office until their respective successors have been elected by the Association." Vicky was elected. Dennis was elected (not re-elected). Vernell was re-elected. Dennis' seat on the board as Paul Hill's successor is now vacant. The board should act promptly (at the December 6th board meeting) to fill that vacancy. One of the five directors elected in November 2021 needs to be removed. How Long Should It Take?

The HOA board held its monthly meeting on Tuesday, November 1, 2022. At the Voting Members' Annual Meeting prior to the board meeting, three directors were elected. The 2023 Budget was approved. How long should it take for the news to reach the 2,480 Members (homeowners) of the HOA? The Directors (McCarthy, Rybicki, Butler) should have been announced on the HOA website and in the November 2022 Scoop the following day. The 2023 Budget should have been published on the website the next day. In fact, the Proposed 2023 Budget should have been published on the website a month ago, when it was delivered to the board. Why wasn't it? What's the big secret? Why wasn't The Summit Scoop ready for publication on Wednesday, November 2nd, right after the election? I'll tell you why. Elected Directors should have been seated tonight

At tonight's HOA board meeting, November 1, 2022, Treasurer Vernell Butler jumped the gun after the corrected election results were announced and stated that the newly-elected directors would take office in January. First of all, it was not his place to make such an announcement. That announcement should be made by the President (who was absent) or by the Vice-President or by the Secretary. But know-it-all Vernell jumped into it. Is that correct? There was a question in my mind about whether he was correct but, at the time, I didn't know the answer. I found the answer in the By-Laws. Art, III, A, Section 6 (c) ¶2.  "The directors elected by the Voting Members shall hold office until their respective successors have been elected by the Association." In the case of Vernell, this doesn't really matter, because he was re-elected. In  Dennis' case, he was already on the board, having succeeded the late Paul Hill. Nov. board meeting - what a joke!

Tonight's HOA board meeting started 20 minutes late, of course, because the annual meeting of Voting Members took more than the 30 minutes allotted to it. Of course, it did. Who planned it for only 30 minutes. Dumb! When the board meeting did start, in a very soft voice Mary Ann Game announced the names of the directors who had been elected. Auby Dellinger, Vernell Butler, Dennis Rybicki. No surprise at all. Well, no surprise at all until Mary Ann announced different election results. Dennis Rybicki Vernell Butler, Vicky McCarthy. Vicky was sitting in the audience and was surprised by that announcement. How does something like that happen? It really instills faith in the election process, doesn't it? HOA Board Election - Nov. 1

The nominees for Directors of the HOA Board to be elected tomorrow night (Nov. 1, 2022) are Auby Dellinger (incumbent) Vernell Butler (incumbent) Dennis Rybicki (incumbent) Tom Glaz Vicki McCarthy Des Haynes Call your Voting Members right now and ask them to vote for  Dennis Rybicki (incumbent) Tom Glaz Vicki McCarthy and NOT for Auby or Vernell. Why not? Auby (Vice President) refused to meet with me to discuss why the board is failing to comply with major provisions of the By-Laws. He's a nice guy to your face. Don't turn your back on him. Vernell is an all-around not-nice person. I have a whole page of reasons he should not be on the board, starting with his inclusion of $230,570 in the 2022 Budget for Salaries. THE HOA HAS NO EMPLOYEES. And I don't like being called a "racist" by him (or anyone else). I don't know Vicki. Dennis shouldn't be on the ballot. Where is the 2023 Proposed Budget?

The Minutes for the October 4, 2022 board meeting read that the Finance Committee has completed the 2023 Proposed Budget and that it has been sent to the board for approval. In the past the proposed budget has been posted for homeowners to examine, in order to make suggestions and requests. Apparently, that is not to be the case this year. If it is posted somewhere, where is it? Want to see it? Call the office. The Finance Committee's report (10/4/22) contains this sentence: " Homeowners are asked to submit any projects that would improve the appearance and safety within the community. " Isn't that special? How are homeowners supposed to know to do so? Who reads the Minutes? Why wasn't that request in the Scoop months ago? And, even if they do so now, the money for their projects won't be in the 2023 Budget, will it? Sort of a waste of letters on a page, wasn't it?

The HOA is not poor

Examination of the financial statements for the HOA from the Minutes of the October 4, 2022 board meeting show several interesting things. The 2022 annual Budget is $1,262,250. That's an average monthly operating expense of $105,187 ($1,262,250/12) The HOA has $869,719.64 in Operating Funds, when its average monthly operating costs are only 12% of that? ($105,187/$869,719) Why wouldn't the HOA save/invest much of that excess at higher (safe) rates-of-return? Is a higher level of expertise needed by those who are responsible for handling the money? The total Reserve funds are $1,187,656.85. Are those funds allocated, or is the slush fund just sitting there for IRS to attack (and attach) it? Safety Committee Report - HOA website

You can count on your HOA to bring you the latest news, right on its website. (Well, you should be able to count on that.) For example, the Safety Committee is part of the HOA. Here is its mission: "Mission: Is responsible for identifying unsafe conditions that exist in the amenity areas and reporting these findings to the Association Board of Directors along with recommendations for rectifying the problems. "Dennis Rybicki , Chair, Clynton Barzey, Auby Dellinger, Mary Ann Game,  Denise Heimlich, and Karen Kranz." On the HOA  website is published a report of the Safety Committee. Go to the website. Stronger State Laws Needed

The following message has been sent to State Representative Ivory Thigpen, who is the District 79 State Rep. The Summit is in District 79. "Good afternoon, Rep. Thigpen, "I am writing to ask your support of stronger laws for HOAs in South Carolina. Compliance by the HOA with CC&Rs, By-Laws, and the Procedures Reference Manual shouldn't even be an issue, but it is a serious one in The Summit. I'll contact your office at mid-month to request a meeting with you to discuss the problems with the Summit's HOA." I'm sure he'll be able to guide me in the steps to get legislation initiated that will give homeowners and residents more power under State law to cause investigation of HOAs that flagrantly fail to comply with their Governing Documents.

Not nice to call Gus a racist

Last week HOA Treasurer Vernell Butler called me a racist three times on NextDoor, and then a fourth time when he called me a "racist BLUF". I had to Google BLUF. It stands for Breeches and Leather Uniform Fanclub, an organization for homosexual men.  You may have read some of Vernell's posts. To one of them I posted a link to the song, "Charlie Brown", by The Coasters. You've heard it - "Why's everybody always pickin' on me?" Serious HOA Irregularity

The Summit HOA is due to elect three Directors to the Board on November 1, 2022, and the Nominating Committee should be hard at work. Last week I became aware of a serious irregularity in the nominations process that the Committee is supposed to follow. The closing date for applications for the board was Friday, October 7, and I submitted an application on October 5. The Committee met on October 13, and on October 14 I received a rejection letter from the Committee "on behalf of the Summit Board of Directors". The problem is that the Committee never received my application from the office! On October 21 I emailed the HOA's attorney and requested assurance of the integrity of the nominations process. I am considering legal action to stop the election, if I don't get that assurance by October 27th. The guidelines for the Committee are crystal-clear in the Procedures Reference Manual (PRM). Apology Issued to Greg Thomas

For several months I have claimed that HOA Board Member Greg Thomas was not eligible to be on the HOA Board. Yesterday I learned that a section of the CC&Rs allows the spouse of a homeowner to be on the board, and I have apologized to Greg. When I first raised the issue, I had found the sections of the Governing Documents that require a board member to be an Owner. Owner is defined as Holder "of record title"; i.e., on the Deed. Greg is not on the Deed. The president of the HOA, Justin Martin, had explained that Greg had acquired a "marital interest" in the house when he married his wife. I believed that was not the same as being legally on the Deed. If his wife wanted to, she could sell the house without Greg's signature. How simple it would have been if Justin had just informed me that Art. III, A, Section 1 reads, in part, " the directors shall be Members or spouses of such Members ". Any other board member or the HOA manager could have informe...

Directors should have HOA email addresses

Currently the HOA officers, including the Directors, use their personal email addresses for HOA business. What happens to the official business emails, when those Directors are not re-elected? Or die in office? Where is the historical record of the emails? Same for the office employees. They use CAMS email addresses of their employer. They are not employed by the HOA. Since they do the HOA's work, all those emails should be on a server controlled by the HOA, not by CAMS. What if, someday, CAMS is no longer the management company for the HOA? Of course, this makes common sense. And this is why the HOA will continue to present plan and, someday, will lose all those important emails. Example, what happened to all the HOA emails on George Reynolds' computer? What happened to all the HOA emails on Paul Hill's computer? Gone. And gone.

Oct. 4th Board Meeting

The October board meeting of the HOA will be Tuesday, October 4, 2022, at 6:30PM at Brookland Baptist Church Northeast, 1203 Summit Parkway. The agenda should include a presentation of the 2021 Audit and a discussion of the work of the Nominating Committee, among other items.  If you wish to run for the board, submit your application to the office by Friday, October 7, 5:00PM. Don't wait until the last minute, in case the office closes earlier. This year's Nominating Committee is Mary Ann Game (chair), Mike Bryant, James Glenn, Jeff Lummel, and Kristie O'Brien.  Auby Dellinger is not on the Committee at this time, because he is a board member and also a candidate in the election (assuming he decides to run for re-election). This year's election of Directors will happen fast. Closing date for applications is October 7. George Reynolds' term - still vacant

Long-time HOA Treasurer George Reynolds died in April 2021. Why did the HOA's Board of Directors never declare his position of Director vacant? Why did the Board of Directors never appoint a successor to George, to serve the remainder of his unexpired term-of-office to November 2022. What the board did do was set up the Voting Members to elect five directors in November 2021, apparently under the mistaken belief that it was replacing George. The VMs should have elected only four. That's what the By-Laws say. I explained their error leading up to the 2021 election and urged the president and the board to seek a legal opinion. Obviously, it did not. Three Directors will be elected in November 2022. George's seat is one of the three. The board is about to create a new problem, because Dennis Rybicki (who was appointed to success Paul Hill) has been told by Justin Martin that he must run for election. September 27 Pre-Board Meeting

Each month the HOA's board of directors meets one week before the next board meeting. What happened at the pre-board meeting on Tuesday, September 27. Often the directors discuss important items and make decisions. The decisions are seldom announced or explained at the next regular board meeting. Such decisions are improper, when made outside of open monthly meetings. No Minutes are kept of pre-board meetings. Or, if they are, they are not published for Members (homeowners) of the HOA to read. The pre-board meeting should be only for the purpose of setting the agenda for the next meeting. And, speaking of the agenda, the board should publish an agenda that is specific to the meeting. It should include New Business and Old Business by item. It doesn't. So "Business" gets lost from one meeting to the next. There is no tracking. No accountability. Are pre-board meetings open to the public? Open to Members (homeowners)? Nov. 8 Election - very important School Board Race

This year's Richland 2 school board election is very, very important. There are 12 candidates. Please review them and pick the four you want before you go to the polls. Don't wait until Nov. 8 to just check four names. I've been attending school board meetings since February 2018, right after the shootings in Parkland, Florida. The school board has been (and still is) a mess. Earlier this year, Gov. McMaster ordered the S.C. Status of 2023 Proposed Budget

Remember the SNAFU last year with the 2022 Budget process? Is the Board doing anything differently this year to assure Homeowners that this process will run smoothly this year? The HOA had three Treasurers last year (2021). George Reynolds served until his death in April, 2021. Then the Board appointed Paul Hill as Treasurer.  At the November 2021 board meeting, Paul Hill, speaking for the Finance Committee, told the board that "the committee is firming up the 2022 budget in the next few days." The Minutes for the December 7, 2021 board meeting state, for the Finance Committee, no update on the 2022 budget. At the top, Paul Hill is listed as Treasurer. At the end of the Minutes, HOA president Justin Martin announced that new board officers had been elected at the pre-board meeting (November 30, 2021) and that Vernell Butler is Treasurer. Therefore, the Minutes were wrong in reporting that Paul Hill is Treasurer. He was not. He had been replaced by Vernell Butler. The proposed...

How to Stop Thefts from Autos

How can you stop thefts from autos? Or, at least reduce them? Homeowners and residents in The Summit continue to experience night-time thefts from vehicles. What can YOU do? 1. Park your vehicles in your garage. Clear out all the clutter and junk in your garage and make room for two vehicles.  Read the CC&Rs.  Article XII,  Section 2. Parking and Prohibited Vehicles. (a) Parking. ... No garage shall be permanently enclosed, nor shall the use thereof otherwise be converted,  such that the capacity for parking of vehicles therein is reduced below that for which it was originally designed . ..." 2. Lock your vehicles.  3. Remove valuables (computers, phones, tablets, firearms, coins, garage door opener). Leave nothing in sight except what came with your car. 4. It's Official ..... Pool open until Sept. 30

It's official. Myrtle Pool will remain open until Friday, September 30th. Of course, the HOA board could have included the week-end of October 1-2, but it didn't.  The HOA office sent out an email blast today. Who got it? Those few homeowners (out of 2,480) who are registered on the HOA's website. If you are one of the many homeowners, and all of the residents, who are not signed up on the website, then you will not get the email.  How many homeowners ARE signed up? It's a big secret. Trying to find out.

One Pool may stay open

Do you swim in a pool of The Summit? If you do, keep a sharp out for a change in the closing date for the Myrtle Pool.  At this week's board meeting on September 6th, residents asked why pools closed so early in hot weather and asked for pools to stay open until September 30. It's beginning to look like the board listened and is taking action. It's not approved yet, but there is a strong possibility that the Myrtle Pool will stay open until September 30. There may or may not be a pool monitor. Since that "monitor" is only a gate guard and not a lifeguard, there is probably no need for a monitor at all. Follow the rules. Don't swim alone. Don't enter the pool at night. If you drown at night, your body will be fished out in the morning. Be kind to your neighbors and the women in the office. Don't drown in the Myrtle Pool. How will the HOA inform 2,480 homeowners and residents? 

Is the Summit Assets Committee hard at work?

The what??? The Summit Assets Committee . From the HOA's website, " Mission: This Sub-committee, is responsible for establishing a balanced annual budget, and presenting it to The Summit Community Association, Inc. Board of Directors for approval. The budgeting process considers input from all levels and includes members from the general community. "OPEN, Chair " This has to be one of the most important Committees of the HOA. Not only is there no Chair(man), there are no members. Why not? Last year (2021) the HOA had three Treasurers : George Reynolds, who died in April 2021; Paul Hill, who was elected Treasurer after George died and who served as Treasurer until November 30, 2021; and Vernell Butler, who was elected Treasurer at the pre-board meeting on November 30, 2021.
