Is Weatherbee the legitimate Board President?
Is Noel Weatherbee a legitimate HOA Board Member and officer?
Two vacancies on the Board occurred in May 2025, when Ciara Bates and LaToya Adams resigned. Both had been elected in November 2024 to two-year terms. Bates had been elected Secretary, and Adams had been elected Treasurer. The vacancies were never announced. The officer positions, required by South Carolina statute, were vacant for approximately 1½ months.
At the Board Meeting on July 1, 2025, then Board President Danny Trapp simply announced that new board members were Noel Weatherbee and William Hill and that Weatherbee would be Secretary. Hill would be Treasurer.
No mention was made about how or when they had been appointed as directors or elected as officers. The process was never reported or published in Board Minutes.
Action should have been taken at a Regular or Special Board Meeting. The Board should have considered candidates or the President's suggestion for those to be appointed, and the Board should have voted on the appointments. The action should have been recorded and published in Board Minutes.
Then the Board, in a Regular or a Special Meeting, should have voted on Weatherbee to be Treasurer (and Hill to be Secretary). No such vote was ever reported or published in Minutes.
That's how it should have been done.
Because it wasn't done that way, Weatherbee never became a legitimate Director of The Summit Homeowners Association.
Only a legitimate Director is eligible to be an officer.
Thus, Weatherbee is not even on the Board. So why is she now claiming to be Board President?
For years the Board has never cleaned its own house. Had it followed its own rules (Governing Documents (CC&Rs, By-Laws, PRM, etc.)), problems like this never would have happened.
Improper actions happened during the entire eight (8) years that I lived in The Summit. It is looking like there won't be enough legitimate Voting Members to hold the 2026 election.
The obvious solution for the protection of 2,480 homeowners is for the South Carolina Attorney General to step in and place the HOA in Receivership.
