Who Is Running the HOA?

On February 12 the Board President emailed me, writing in part, "I am requesting you not contact me with suggestions or comments on how to run the Association."

That was after I had requested a meeting with the board, and she responded by saying that they were unanimous that "no settlement will be offered". I hadn't asked for a settlement; I had requested a meeting!

She was polite in her message (which some other board members have not been), and so I have not contacted her again.

But who is helping her run the Association? Any of the other Board Members? The hired Property Manager? Any of the Voting Members? Anybody?

The Board of Directors has seven directors. It is the Board that is responsible for running the Association, not one person. If there are failures, they are of the Board, not of one person.

The Association (HOA) has big issues. If you have read recent articles here, you know what they are.
  • Failure to publish the 2024 Annual Audit;
  • Recovering the cost ($25,-$30,000?) of the lawsuit against me that violated the CC&Rs and was never approved by the Board;
  • Purchase of an annuity on a board member with Reserve funds ($126, 351.61);
  • Huge drop in Cash ($445,000+) between 1/31/25 and 1/31/26;
  • Failure to publish the 2026 Approved Budget. (Did the Board ever approve it?);
  • Failure to publish monthly Financial Operating Results after August 2025;
  • Failure to publish the Minutes of the March 3, 2026 Board Meeting promptly.
With the cancellation of BOD meetings every month, what decisions will the Board be making in private? Will the Board meet in workshops, pre-board meetings, and other non-public (to Members) meetings that are not fully reported promptly in published Minutes? 

Danny Trapp tried to shut me up with an illegal lawsuit last year. That didn't work. It was "illegal" because it was filed in the name of the HOA, but the lawsuit was prohibited by the CC&Rs (Art. XIII, §10 Litigation) and the Board never approved it (because it couldn't.) The HOA should recover all the money that was paid out for it.

The Voting Members should be demanding answers and action, on behalf of their neighborhoods. Are they?
