Why The Summit's HOA Must Act

The Summit's HOA must take action to create legitimate Voting Members from all 28 Neighborhoods. 

Why?

Because its Board of Directors is not legitimate. The Officers are not legitimate. 

This "can" has been kicked down the road for many years by previous boards of directors, which included persons who served many terms and controlled decisions made by the board.

Previous boards ignored complaints about their non-compliance with the By-Laws. Previous boards allowed fraudulent elections of directors to take place in year after year. They allowed ineligible homeowners to elect directors. It was classic Voter Fraud.

The By-Laws state that each of the 28 Neighborhoods must hold an Annual Neighborhood Meeting, elect a three-member Neighborhood Committee, and select a Voting Member who serves for one year. The position is not perpetual. It's not a lifetime appointment. "Getting signatures" is not a legitimate way to become a Voting Member.

The Barony Place Neighborhood is now in compliance. But it is only one of the 28 Neighborhoods.

The HOA cannot hold an election of directors.
The HOA cannot retain a new law firm.
The HOA cannot replace CAMS or hire a new HOA management company.
The HOA cannot contract for forensics or other special audits.
The HOA cannot conduct banking operations.
The HOA cannot pay bills.

In its approach to a new law firm, did the persons disclose that they are not legitimate officers and that the entire board was not duly-elected and that they have no legal authority to conduct business on behalf of the HOA?

What should the people claiming to be the HOA's leaders do immediately?

They should support 27 Neighborhoods in holding Neighborhood Meetings within 30 days. They should see that legitimate Voting Members are in place.

Then the Voting Members should hold a Special Meeting and elect Directors. They might elect the same people. They might elect other people.

Is the Summit's HOA at risk for dissolution or take-over by the State of South Carolina?

If the S.C. Attorney General or S.C. Secretary of State initiated legal action against the Summit's HOA, how expensive would that be for the homeowners? Keep in mind that the 2024 Budget started with a $27,000 deficit

It's the By-Laws that control. I'm just the messenger.
