Best Part of Tonight's BOD Meeting
The best part of tonight's Board Meeting was the ten minutes before it started.
I was seated toward the rear of the meeting room, and the Property Manager approached me, asking me to step outside the room.
The first thing I said was, "I don't know who you are. Who are you?" He answered, "Robert Williamson."
I asked him what he wanted, and he asked again for me to step outside the meeting room. When I told him that I wasn't going to do so, he looked around and a male RCSD deputy walked up. I explained, politely and respectfully, that I wasn't going to step outside. I added that deputies attend the board meetings to give their safety report and to keep the peace. I explained that I wasn't committing any crime.
I asked that deputy to have Capt. Danny Brown join us. He was nearby. I explained again and Capt. Brown said he would have to make a phone call. Capt. Brown, the male deputy, and Robert never returned.
Apparently, the Board learned little about my knowledge of the law and of corporate procedures during the past 14 months. It was expensive for them. How much? I estimate they paid $25,-$30,000 in legal fees and costs to sue me. The Board didn't bother to have any board member in the courtroom for any of the hearings.
The HOA shouldn't have paid anything to the law firm. Every dollar was an illegal disbursement of HOA funds. Why? The CC&Rs prohibited the litigation. The Board never approved the lawsuit. Plus, it couldn't have approved it, even if it had wanted to.
They don't get answers from me for free, anymore.
Question: Is disbursing HOA funds without Board approval a crime?
