Does this apply today to The Summit's HOA? Right now, evil is triumphing.
The Voting Members represent the Members - the homeowners - YOU.
Voting Members now know that the HOA has filed an illegal lawsuit against a resident.
Why is it illegal?
The lawsuit is illegal because it was filed in the name of the HOA, but without the approval of the Board of Directors.
The HOA is prohibited in the CC&Rs (Art. XIII, §10) without prior approval of 75% of the Voting Members.
Voting Members were never asked to approve, and they never did approve.
The Board never voted in a Regular Board Meeting to approve the lawsuit.
The Board never authorized Danny Trapp to file the lawsuit.
The HOA is paying a big Columbia law firm to handle the lawsuit.
These payments are illegal disbursements of HOA funds, because the Board never approved the lawsuit.
Danny Trapp knew, or should have known, that the CC&Rs prohibit the lawsuit.
The lawyers knew, or should have known, that the CC&Rs prohibit the lawsuit.
The Covenants Committee addressed the Board at the August 5, 2025 Board Meeting and told them that the litigation (against me) violates the CC&Rs. Please read the Minutes.
Why aren't all the Voting Members representing their homeowners and demanding that the lawsuit be stopped?
The Voting Members should start removing Board Members until those who are left call off the lawyers.
The Voting Members need not be concerned with Gus Philpott (me). It doesn't matter whether they like me. Forget me. I'm taking care of me - and doing a good job of it. They represent YOU. Or they are supposed to. If their allegiance is to Danny Trapp instead of to the HOA and you, they should be replaced.
If they condone the illegal lawsuit that was filed, then they should be replaced. Neighborhoods can do that very easily by holding a Neighborhood Meeting, electing a new Neighborhood Committee, which will elect a new Voting Member.
"The Voting Member of a Neighborhood may be removed, with or without cause, by the vote or written consent, or combination thereof, of a majority of the Members of the Neighborhood." (By-Laws, Art. V, § 3, ¶3)
