Is Danny Trapp the Right President?
For the good of the HOA, should Danny Trapp resign immediately as President and from the Board of Directors?
If he doesn't, should the Board of Directors hold a vote to remove him?
If the Board won't remove him as President, should the Voting Members convene a Special-Called Meeting to vote on his removal from the Board?
Is Danny serving on the Board and as President in the best interests of the Association and its 2,480 Members?
Look at some of Danny's actions:
- Started an unauthorized lawsuit against Gus Philpott without the approval of the Voting Members (CC&Rs, Art. XIII, §10) and without approval of the Board of Directors. No record exists in the Minutes of any approval by the Board.
- Abruptly adjourned the April 1, 2025 Board meeting without a vote of the Board.
- Upon information and belief, Danny has unilaterally appointed himself as the only director who can contact the HOA's attorney.
- Is believed to have led a denial of a dues increase at the October 2024 pre-board meeting. No decisions are supposed to be made in private, closed, pre-board meetings, for which no Minutes are published.
- Did not require the Finance Committee to present the 2025 Budget at the November 12, 2024 board meeting, as is required in the PRM.
- Did not enforce the requirement in the CC&Rs (Art. X, §6) for the 2024 or the 2025 Budget to include a sufficient contribution to Reserves for future expenses.
- Has not conducted monthly meetings in a professional, business-like, and respectful manner.
- Unilaterally declared that public comment will not be allowed at monthly board meetings.
- Unilaterally declared that only homeowners with valid Summit ID cards can attend board meetings.
- Unilaterally declared that residents can no longer attend monthly board meetings, although "Board meetings are open to all Summit Residents" (Summit Scoop, Page 2).
The Board won't remove him, because he has three friends who will vote with him and prevent the other three from gaining approval. If LaToya Adams or Tanisha Holmes would do what's best for the HOA, then the minority three, plus one or both of them, could remove Danny as President.
The Voting Members are so disorganized and ineffective that they won't remove him. Plus there is only one legitimate Voting Member, far short of the number required as a quorum for a meeting of the Voting Members. Of course, if they can't meet to remove Danny, they also cannot meet to vote for Directors in November (2025) and shouldn't have met and voted in November 2024 or 2023.
