Compliance with the By-Laws

The Minutes of the January 6, 2026 Board of Directors Meeting indicate that the Board will be looking into the way in which homeowners are chosen to be Neighborhood Representatives. I did not attend that meeting, because the lawsuit against me had not yet been dismissed.

At the February 3, 2026 Board Meeting there was no follow-up to this. 

Mary Ann Game (Voting Member* for Pine Brook) made some comments about the Neighborhood Committee (some of which I did not think were accurate, based on the By-Laws). For example, the By-Laws do not state that all Voting Members are automatically members of the (HOA's) Neighborhood Committee.

A homeowner who is a Voting Member certainly can become a member of the (HOA's) Neighborhood Committee, but the Neighborhood Committee is not a committee of the Voting Members.

The Minutes of the January 6th meeting read, in part on Page 5,

Neighborhood Representatives & Election Process 

"A detailed discussion occurred regarding the neighborhood representative structure and election procedures. The Board clarified that homeowners vote for neighborhood representatives, and those representatives vote for Board members. [emphasis added.] Concerns were raised regarding communication gaps and awareness of representatives. 

"The Board acknowledged the concerns and confirmed it is actively reviewing election procedures to ensure alignment with the CC&Rs. 

"Action Item: 

"The Board will meet with neighborhood representatives and review the election process for consistency and transparency."

This is a thorny issue that previous Boards have disregarded. Did the Board meet with the neighborhood representatives?

This Board (Bryant, Lummel, Moore, Potter, Hill, Weatherbee, Holmes) "clarified that homeowners vote for neighborhood representatives". 

The Minutes are incorrect about "representatives vote for Board members." It is the Voting Members who vote for Board members.

What is "alignment" with the CC&Rs (and the By-Laws)? It's not just alignment; it's compliance!

Homeowners are supposed to elect Neighborhood Committees every year. It hasn't been that way for many years. Will this Board make sure that starts happening?

Mary Ann Game acted as if she is the chairperson of the (HOA's) Neighborhood Committee. The February Summit Scoop (published February 12th) lists that committee as not having a chair. The Board has never approved her appointment to that position.

* Is Mary Ann a legitimate Voting Member? She must have resigned from the Board in October 2023, so that she could attend the Annual Meeting of Voting Members on November 7, 2023 as a Voting Member. Did Pine Brook (188 homes) hold a Neighborhood Meeting with a quorum (63) and elect her? Why doesn't Pine Brook have two Alternates? Or did she "get signatures"?
