Recent happenings with the HOA have reminded me of a t-shirt I saw years ago in Colorado.
I DON'T GET MAD
I GET EVEN
I'd rather be friends with the Board of Directors and the office than be their foe. I'm in charge of my end of the relationship; they are in charge of their end.
If they are fair with me, I'll be fair with them.
Complying with the CC&Rs and the By-Laws isn't negotiable. The Board is required to do that. If they don't, they are violating their obligation to the Members and their fiduciary responsibility.
The Board is not accountable to me. I'm a resident, not a Member. But that doesn't mean they can run willy-nilly over the Members (homeowners), disregard the Governing Documents, and get away with it.
For years various Boards have talked about amending the CC&Rs and the By-Laws. The truth is the HOA cannot do that.
The reason? There aren't enough legitimate, duly-elected Voting Members.
The lack of enough Voting Members doesn't prevent the Annual Meeting of Voting Members and election of directors. It should prevent that, but it doesn't.
This is the first problem for the Board to fix. They hinted at it in the Minutes of the January 6, 2026 Board Meeting. where this entry appears under New Business.
"A Board member acknowledged concerns regarding the recent election process. Legal counsel advised that while the process was not ideal, the Board may continue as seated and correct procedures in the next election cycle."
Of course, the process wasn't "ideal". The process was not in compliance with the By-Laws. People were allowed to vote for directors who were not legitimate, bonafide, duly-elected Voting Members. For years I have called that "Voter Fraud".
This is gone on for years. Now is the time to fix it - before November 2026!
If the Board would ever like to discuss the content of my blog with me, all they have to do is ask.
