Abusive HOA Loses Out on $500/day Fines

A homeowner replaced an interior door in her condo, and her HOA began fining her $500/day.

This is just one abuse by one HOA in the USA.

Another abuse? When a HOA files a lawsuit against a resident that is specifically prohibited in the CC&Rs. Especially when the Board of Directors of the HOA never approved the lawsuit. And when the Board of Directors never authorized the President of the HOA, Danny Trapp, to file the lawsuit. 

In this case, the Board of Directors couldn't even have voted on a Motion to approve the lawsuit (if one had been made, which is wasn't), because it had not first obtained the approval of 75% of the Voting Members (of The Summit's HOA).

How does such an abuse happen? 

It happens when all Board members are not committed to complying with the CC&Rs and the By-Laws. And when six Board members allow the President of the Board to violate the CC&Rs and they do not take action to stop him.

The Summit's HOA spent $13,024.69 in Legal/Professional Fees (Line 6500) in the first five months of 2025. How much of that was on the illegal lawsuit? 

How high will the legal bills for the Contempt Motion (filed by the HOA) that was heard on July 24, 2025?

How high will the legal bills be for the demands ((1) Plaintiff’s First Interrogatories to Defendant and (2) Plaintiff’s First Request for Production to Defendantsent to the Defendant (me) on July 29, 2025?

How high will the legal bills be for the trial, which may start in September?

Who is paying those legal bills for legal action started by the HOA which was never approved by the Board of Directors and which was prohibited in the CC&Rs?

Why aren't the Voting Members representing you, the Members (homeowners) in the HOA?
