Should Voting Members Refuse to Re-Elect Danny Trapp?
Less than 11 weeks from now, on November 4, 2025 the Voting Members of the HOA will assemble for the 2025 Annual Meeting of Voting Members.
The By-Laws assume that only legitimate, duly-elected Voting Members can attend. The HOA should comply with this requirement. The Property Manager should certify the legitimacy of each Voting Member. A list of bonafide Voting Members should be called and answered. Unless something happens between now and then, there will be only one legitimate, duly-elected Voting Member in attendance. That's not enough for a quorum!
The Annual Meeting of Voting Members requires a quorum, which could be 15 of the maximum number of 28 Voting Members.
What will probably happen? The Board President and the Board Secretary will likely allow, as in past years, all those Voting Members listed in The Summit Scoop and on the HOA's website to attend, whether or not they are legitimate.
Directors are elected by Voting Members. According to the By-Laws, if there aren't enough eligible Voting Members to make a quorum, the Meeting should be adjourned and re-scheduled. No election should be held. My guess is that has never happened in this HOA.
The Nominating Committee comes up with a slate of candidates. At this time (8/21/2025) the website listing of committees, but not the list in the August Summit Scoop, shows Patricia Pollin is the chairperson of the Nominating Committee. Yes, that Patricia Pollin. The person who shouldn't even be on the Board.
Will she see that Danny Trapp is on the ballot for re-election? What odds would Jimmy the Greek give on that bet?
Why shouldn't Danny Trapp be re-elected?
- Trapp recognizes as Voting Members homeowners who have not been duly-elected by their Neighborhoods;
- Trapp has not required the HOA's Neighborhood Committee to assist all the 28 Neighborhoods to hold Neighborhood Meetings, elect Neighborhood Committees, and elect legitimate Voting Members.
- Trapp doesn't run Board meetings effectively or efficiently;
- Trapp won't use the microphone so that all can hear;
- In November 2023 and November 2024 Trapp did not conduct the Organizational Meeting of the HOA (election of officers) in public and during the Board Meeting immediately after the Annual Meeting of Voting Members, as required by the By-Laws;
- Trapp started the lawsuit against Gus Philpott (me) without a Board vote and without approval of the Voting Members;
- Trapp does not direct the Board Treasurer to refuse making illegal disbursements of HOA funds in payment of invoices from Turner Padget for the unapproved, prohibited lawsuit against Gus Philpott (me);
- Trapp was not in favor of a dues increase before the November 12, 2024 Board Meeting;
- Trapp did not require or allow the 2025 Proposed Budget, as created by the Finance Committee, to be discussed in the open November 12, 2025 Regular Board Meeting;
- Trapp did not allow the Finance Committee to recommend a $50 increase in Assessment for 2025;
- Trapp allowed the 2025 Budget to be voted on by newly-elected Board members (Adams and Bates), who never even looked at it before voting;
- Trapp allowed a 2025 Budget to be approved with only a $3,000 contribution to Reserves;
- Trapp abruptly adjourned the April 1, 2025 Board Meeting without a vote, thereby eliminating a discussion of the trampoline issue that had brought so many homeowners to that meeting.
For those reasons and others, Voting Members should refuse to re-elect Danny Trapp on November 4, 2025.
There is time to search The Summit for a strong, organized, business-oriented, financially-savvy, candidate for the Board and its next President.
