The TRUTH. Still Two Board Vacancies; no Secretary, no Treasurer

The Board of Directors of The Summit's HOA still has two vacancies on the Board (should have three) and still has no Secretary and no Treasurer.

The Board will tell you there are no vacancies and that it has a Secretary and a Treasurer.

But that is not true. Why not?

The Board made decisions, improperly, on July 1st in a private, closed, secret, pre-board meeting. That meeting was before the Regular Board Meeting, which was scheduled to start at 6:30PM.

The Board claimed it had met in Executive Session. It did not. It announced results from that prior meeting.

The Board does not understand Executive Session rules. It should have first started the Regular Meeting. Then, after Motion and vote, it could recess into Executive Session. It didn't do that.

The next irregularity was making decisions in "Executive Session" and merely announcing them in the Regular Meeting. 

Was all that done at the prompting or direction of the HOA's President, Danny Trapp?

Someone might ask, "Who the heck does he think he is?"

I believe there are two board members who don't agree with what Danny does much of the time. While they are in the minority, that should not keep them from contacting the attorney for the HOA and getting legal advice for the HOA. Neither communicates with me. Knowing them since before the Court ordered me not to attend meetings or communicate with anyone on the Board is what helps me form the belief I have.

The HOA pays the attorney (or should). Turner Padget is the law firm for the Association. It is not Danny's attorney. It is not the Board's attorney. It represents the Association. And it should do so.

Generally, a law firm may only respond to requests for legal advice. So Directors Brenda Bryant and Linda Potter should ask Turner Padget for advice.

I could save the HOA $1,000 and tell them what the attorney will tell them. 
"The HOA must comply with the Governing Documents, and it is supposed to follow Robert's Rules of Order. The appointments of Noel Weatherbee and William Hill to the Board were not legitimate. Because the appointments were not legitimate, Weatherbee and Hill cannot be officers." 

Danny and the board majority will not listen to me, I am not an attorney, and the Court has ordered me not to communicate with the Board. There certainly is no requirement or obligation to "listen" to me. 

Bryant and Potter should spend $1,000 of the HOA's money and have the attorney tell them the truth.
