SUMMIT HOA SUES RESIDENT, SEEKS TRO

Columbia, S.C. February 5, 2025 – The Summit Community Association, Inc. ("Summit HOA"), filed a Summons and Complaint against resident Gus Philpott on December 30, 2024 in Richland County Court of Common Pleas, Fifth Judicial District. Summit HOA is also seeking a Temporary Restraining Order (TRO) against Philpott.

Since July 20, 2020 Philpott has been writing a blog about the actions of the Summit HOA. It started with a Parking Violation Notice for a friend’s car parked on the public street in front of his residence. A Hearing for the TRO is scheduled for Tuesday, February 11, 2025 at 2:00PM in the Common Pleas Court of Judge Coble.

Philpott has been reading and studying the CC&Rs and the By-Laws of the Summit HOA for more than five years. He has determined that there are serious irregularities in the process for electing Directors and Officers. He has been critical of their financial affairs. In 2024 the HOA over-spent its budget in 12 categories by $131,480, in addition to starting that Year with a prohibited deficit (almost $28,000).

Philpott lives in the one neighborhood that has a legitimate Voting Member (homeowners’ representative). 19.6% of the homeowners are not represented at all, and others are represented by persons who were not duly-elected in compliance with the By-Laws.
