Realization - Why HOA Hates Gus
I think I figured out why the HOA (the members of the Board and the office) hate me.
When I have asked them a polite and business-like question in the past, they have either not answered at all or responded in a way that didn't answer the question.
And so I have asked a second time. And additional times. Had they said that they were not going to answer the question, I would not have asked further. I would have found an alternate way of getting the answer. The HOA is a business. Shouldn't it operate "like a business"?
Example: When I was told that "We are not allowed to park in the streets", I asked why not. Twice. With no answer from the chair of the Safety Committee. The truth is that anyone CAN park in the streets.
Last June when the office sent me a list of the number of homes in each neighborhood, the number totaled 2,595. However, there are 2,480 homes in the HOA. When I asked for a corrected list, the office stopped communicating with me.
When I have asked about the scheme of recognizing people who "get signatures" as "Voting Members", an early answer was that it was too hard to get homeowners to Neighborhood Meetings. So what??? The By-Laws require Annual Neighborhood Meetings and elections (not "getting signatures"). It's not too hard. All it takes is a little planning.
The Board talks about amending the By-Laws. It cannot do so, because there aren't enough legitimate Voting Members to approve the changes.
But, if you don't watch out, the Board will do it anyway, and call it "Done".
There are three solutions.
- Persuade the Board to comply with the By-Laws;
- Elect a Board of Directors that will comply with the By-Laws; or
- Haul the HOA into Court and ask a judge to order the Board to comply with the By-Laws.
