Where are the "Voting Members"?
Every month Voting Members are listed on the HOA's website and in The Summit Scoop. There are 28 Neighborhoods, and there should be 28 Voting Members.
Approval of the Voting Members was required, before the HOA could sue Gus Philpott. Before the Voting Members could approve, they had to get the approval of 75% of the homeowners in their neighborhoods. This is based in the CC&Rs, Art. XIII, Section 10.
Were you, a homeowner, asked to approve the lawsuit?
Did the Voting Members ask their homeowners for approval?
Did the Voting Members then approve the lawsuit?
Did the Board of Directors ever vote in public to approve the lawsuit.
I believe the answers are No, No, No, and No.
But that didn't keep Danny Trapp, currently President of the HOA, from telling the lawyers to go ahead.
How much money (your money) has the HOA spent since August, when a Cease and Desist Letter was sent to Gus Philpott?
Does the Board even know?
Why are the Voting Members sitting on their hands, instead of demanding that the Directors comply with the CC&Rs and the By-Laws?
Do the Voting Members realize that this unauthorized lawsuit is likely to cost the HOA $25,-$35,-$45,000 before it's all over?
What has the HOA won so far, for its legal expenses?
1. Gus Philpott can't communicate with members of the Board. Big deal.
2. Gus Philpott can't communicate with the office. Big deal.
3. Gus Philpott can't go to meetings. Big deal.
