Is President's Report True?

Once again the Board President, Danny Trapp, has written in the Summit Scoop about street parking.

In the October 2025 Scoop, published today, he wrote on Page 1 in the President's Report:

"As a reminder, our covenants governing parking on the streets in our community are valid, legal and enforceable."

If you think he is right, then ask him what Section in the CC&Rs governs parking on the public streets. If you get an answer, please let me know what he says.

If his sentence is true, former Board President Justin Martin would have been able to cite the Section in the Covenants that covers parking on the streets in The Summit, when I asked him back in 2018 or 2019.

If that sentence is true, then William Hill, Safety Committee chair, would have replied to my two emailed requests in November and would have provided the Sections. Instead, he did not reply to either email. Ever.

It is true that the Covenants, in general, are valid, legal and enforceable.

It is my belief that there is nothing in the Covenants about street parking.

The streets are public roadways. Parking violations are enforceable only by Richland County and the State of South Carolina. 

Speaking for the street (Barony Place Circle) in Barony Place II, there is nothing in the Deed recorded in the County about any parking restriction or about the CC&Rs.

Same for lower Barony Place

When the Developer was ready to part with any of the streets, he could have transferred the streets to the HOA, not to the County. Then the HOA could have tried to attach the CC&Rs, when it wanted to transfer the streets to Richland County.

My guess is that the County would not have accepted the streets with such a restriction. 

My opinion is that the HOA has no authority whatsoever about parking on the public streets in the Summit.
