Why Didn't CAMS File in 2021?

Back on February 2, 2021 the Voting Members voted on a Referendum pertaining to 
  • annexing Richland County Parcel R23100-01-02*;
  • sheds;
  • above-ground pools;
  • portable basketball goals; and
  • garage sales. 
Above-ground pools were not approved.

It has come to light recently (see the Minutes of the October 7, 2025 Board Meeting) that CAMS did not file the proper paperwork with Richland County. That Referendum must be redone.

Did CAMS have a valid reason for not filing the paperwork? Was the "paperwork" Amendments to the By-Laws or CC&Rs?

Voting Members would have first been required to determine whether their respective property owners were in favor of (or opposed to) the questions in the Referendum. Then Voting Members would have had to vote on the Referendum. According to the February 2021 Summit Scoop, they voted on February 2, 2021.

What if CAMS knew there were no legitimate Voting Members and decided not to file fraudulent documents? Could that have been the reason CAMS did not file with the County? If that was the reason, did CAMS inform the Board?

Why didn't the failure to file come up years ago? Why didn't Justin Martin (then-Board President) and Greg Thomas (then- Board Secretary) determine and announce that lapse? Or did CAMS just overlook filing? Was the HOA's lawyer ever consulted about the Referendum? Wouldn't the lawyer have been involved in filing documents with the County's Recorder of Deeds?

The October 7, 2025 Minutes include "Homeowners with existing items will not be penalized." In other words, if you put up a shed, you're in the clear. That is not correct.

If sheds were never legally allowed and if you put one up, then legally you are going to have to remove it. This will create a major and expensive legal headache for the HOA. The Board will need legal advice on resolving the issue. One line in the Minutes is not going to do it!

* There is no Parcel R23100-01-02 on the Richland County GIS Map. Was there a typo in the Scoop in 2021? What Parcel Number was in the Referendum? The parcel to be annexed was probably the strip along Summit Parkway behind 301, 303, 305, 307 Rolling Knoll Drive, where four new houses were built.
