An Open Letter to All Voting Members:

According to the By-Laws of the Summit's HOA, Voting Members are the representatives of the property owners (homeowners) in the Association.

Do you, the Voting Members, know what the Board of Directors is doing (and not doing)?

Starting with Board Meetings - the Board has been meeting at many times other than the Regular Monthly Meetings on the first Tuesday of the month. How many of those "extra" meetings have there been since January 1, 2025? You should obtain the dates for every meeting of the board and inspect the Minutes of every meeting.

Why haven't ALL Board Members been informed of ALL of those meetings, and why haven't ALL been invited to every meeting? Who has not been invited or attended?

Why are some Board Members being excluded from Board Meetings?

What is being discussed at meetings from which certain board members are excluded?

Voting Members should appoint five-to-seven clear-headed, unbiased Voting Members to investigate the actions of the Board and to report their findings publicly to the Members (homeowners) and to the Board.

There is even time for this to get started, and possibly be completed, by the date of this year's Annual Board Meeting. What is that date? No one really knows.

It is supposed to be the first Tuesday of November. That would be November 4. Some feel the Annual Meeting should not be that day, because it is (municipal) Election Day. Brookland Baptist Church Northeast is not available that day, because it is a polling place. So what? The Board should have found a different meeting place.

For months (September, October) the November meeting date has been published in The Summit Scoop as Tuesday, November 11. However, as of Friday, October 17, the Church does NOT have a HOA meeting on its Church calendar for November 11.

According to the Minutes of the October 7th Board Meeting, in the report of the Nominating Committee, "Meeting scheduled for the second Tuesday of November, [sic] may be rescheduled."

What "Meeting"? The Annual Meeting of Voting Members (AMVM), when the election of four directors is to take place? The Annual Meeting of the Board, which follows the AMVM and should include the election of officers for the following year?

How could the Board not be certain of the date and place of the two most-important Association meetings of the year, when they are only a month in the future?

Why did the Board President file a lawsuit in December 2024 in the name of the Association, but WITHOUT the approval of the Board? The lawsuit is prohibited by the CC&Rs. The lawsuit is not just a violation of the CC&Rs; it is illegal! The Association is not the Plaintiff! At the August 5, 2025 Board Meeting, for the Covenants Committee and as reported in the Minutes,

"Jamie Burke, committee member, reported that the board initiated litigation against a Summit resident in December 2024, which violates the CC&Rs, Article 13 [sic], Section 10. This action would need to be approved with a vote of 75% of the voting members."

What action did the Board take on that report? None. 

The statement is not correct and may not be exactly what Jamie said. More correct would be, "This action would have required the prior approval of 75% of the Voting Members, after the VMs got approval of 75% of their respective homeowners." A nearly impossible burden. 

Is this the majority on the Board of The Summit's HOA?

Actually, the board did not initiate that litigation, because the Board never approved the filing of the litigation. It also never authorized the Board President to file it. Why not? Because it couldn't, according the CC&Rs. 

So why the Board President, Danny Trapp, file it the name of the Association? And why did the Association's lawyer file it?

What legal action should be taken against Danny Trapp for illegally filing a lawsuit in the name of the Association

Why did the Board President ask the Brookland Baptist Church Northeast to ban three homeowners and one resident from Church property, effectively banning them from attending the monthly HOA meeting? Two of those homeowners are Voting Members. The third will be a Voting Member by the date of the November Annual Meeting. Did the Board approve his action by vote? When?

What did Danny's letter to the Church, received by it on September 15, 2025, say?

Have recent HOA Board Meetings at the Church been so out-of-control that some members of the Church are concerned about their safety? Who is responsible for conducting the Board meetings and keeping order? Why didn't the Board President arrange for security? Why don't the Minutes of Board Meetings reflect any disorder or disruption? 

By the way, Gus Philpott hasn't attended any Board Meetings since February 4, 2025, so he could not be suspected of being part of any disorder during recent meetings.
