Which applicants for the Board of Directors were not accepted as candidates for election?
The Nominating Committee met last Saturday to interview all the candidates.
One of the qualifications for a candidate is "free from any personal agenda".
Paragraph 10 of the Procedures Reference Manual (Art. III, §H) reads "The Nominating Committee may decide not to nominate a Candidate (should read Applicant) if there is a conflict of interest, if the candidate has a personal agenda, has lied on their application or other reasons."
That should have eliminated two of the candidates. But did it?
Danny Trapp clearly has a personal agenda. He filed a lawsuit against a resident who has been outspoken about numerous violations by the Board of the CC&Rs, By-Laws, and the PRM. Danny filed the lawsuit in violation of the CC&Rs and without the approval of the Board of Directors. He also sought a Temporary Restraining Order against that resident in the name of the HOA but without the approval of the Board of Directors. He has also removed homeowners from committees without reason or cause.
Wouldn't those actions be a "personal agenda"?
Did the Nominating Committee hold its closed-door meeting after the interviews to select the slate of candidates for the November election? Will the Committee announce who the candidates are, or will it be a secret until after the election, as in past years?
The Nominating Committee should present its slate of four candidates now. It could send an email to all homeowners. The homeowners could inform their Voting Members of reasons to vote for (or not to vote for) certain candidates.
Will there be any other nominations or self-nominations before the election? On election day, each candidate is to have two minutes to "sell" himself to the Voting Members.
Will there be any write-in candidates? Will they be allowed two minutes to speak?
The Minutes of Saturday's Nominating Committee meeting should be available to Voting Members and to Members (homeowners). But how big a struggle would it be for them to inspect those Minutes?
