Parking "Reminder" Is Wrong
Town & Country, the HOA's new property management company, emailed* an erroneous message to Members on November 26. It read, in part,
"As many residents will be welcoming guests over the holiday, we kindly ask everyone to be mindful of parking etiquette within the community. To help ensure clear roadways and maintain a pleasant environment for all:
* Please park your vehicles in your garage whenever possible.* Encourage guests to utilize your driveway.* Street parking should only be used when absolutely necessary.
"Your cooperation helps keep our community safe, accessible, and enjoyable for all residents."
The Summit's HOA has never identified a Section in the Governing Documents that applies to street parking. The streets are public roadways, owned and maintained by Richland County. Public roadways are not part of the Common Property of the HOA.
If your guests or you wish to park in the street, do so. If cars are parked so as to block the roadway, a deputy or state trooper will ticket the offending vehicle(s), if you call them. The HOA has no authority to issue a parking violation notice or to threaten or impose fines for on-street parking.
Like Charlie Kirk said, "Prove me wrong."
Town & Country is on thin ice, when it mimics former board president Danny Trapp. In 12 months William Hill has not replied to my two requests to identify any relevant Section in the Covenants or By-Laws, after he emailed me that "We are not allowed to park in the streets."
The HOA can enforce parking on Common Property or on your lot, but not on the streets. See the CC&Rs, Art. XII, §2.
If parking restrictions existed for County roads, there would be County-authorized No Parking signs on every street all over The Summit.
* Why does the HOA send an email blast from "Robert Williamson <donotreply@appfolio.com>"? Why not show the Sender as "Summit HOA"? How many HOA Members don't have a clue who Robert Williamson is?
