How Much Will Danny's Letter Cost the HOA?
In mid-September Danny Trapp, Board President, sent a letter to Brookland Baptist Church Northeast. That's the church where the HOA has been holding its monthly board meetings, for which it "donates" $1,000/year. (It's not a "donation", because it gets value in return.)
As a result of Danny's letter, which the church received on September 15, the church banned four men in The Summit from its church property, effectively preventing them from attending HOA meetings. Three are homeowners and Members of the HOA. Two of them are Voting Members. One is almost the new Voting Member for Indigo Springs.
Was Danny trying to keep them from attending the Annual Meeting of Voting Members, which was scheduled to meet at the church on November 11? That would keep the three from voting for directors. None of the three would have voted for Danny. They would have voted for anyone else, costing Danny three votes.
Did Danny ask the Board for approval to send that letter? Or to send a letter dated October 3rd with a copy of the church's letter to the four men? The letters were delivered the day before the October board meeting, and the three Members did not attend the board meeting because of the church's letter.
The ban won't interfere with their voting now, because the meeting is no longer at the church.
There may be certain actions Danny can take without Board approval. I can think of two he cannot:
1. Filing a lawsuit in the name of the HOA without the approval of the Board; and
2. Seeking to have three Members and one resident banned from the meeting location of the Board.
The Church has been slow to admit its mistake and to retract the Trespass Letter, which probably isn't even valid.
I don't have a copy of Danny's letter to the church - yet. I suspect I won't like it, after I read it. If it is injurious to me, the HOA will be expected to pay for it.
