What Has the HOA Unleashed?

Justin Baldoni has given me a great idea.

He is suing Blake Lively and Ryan Reynolds for $400,000,000 for defamation.

Because of the HOA's legal action against me, my reputation in The Summit has been destroyed. I am suffering and can hardly t-t-type. My dog looks at me in a strange way. I can't sleep. Will I be able to cook without burning the bacon? Will my neighbors stop speaking to me (more than they already have, I mean)? Will the members of the BOD continue to shun me?

What am I to do?

You know, $400MM does have a nice even ring to it. And, after my lawyer takes his cut and retires, I'll still have more than $200MM.

Do I apologize now for the huge Special Assessment ($400,000,000/2480=$161,290 per home) or wait until I cash the check?

Look at the list of Board Members in the January 2025 Summit Scoop, so that you'll know whom to "thank".

What was the Board's vote to file legal action against me? 7-0? 6-1? 5-2? 4-3? Was there a vote? When? If you voted against it, be sure that the Minutes reflect your No vote.

The vote will come out during Discovery. Get ready for your deposition. Be prepared to take an oath to tell the truth, the whole truth, and nothing but the truth and to testify in court, after you are subpoenaed. 

Maybe after this is all over, homeowners will wake up and elect Voting Members who will actually represent them and who will elect directors who will run things differently, who will elect officers to make different decisions.

Barony Place Neighborhood (Barony Place I and Barony Place II attempted to hold a Neighborhood Meeting this afternoon. Of the 78 homes, seventeen (17) homes were represented, and that was not sufficient to meet the quorum requirement of 26. Open Letter to Barony Place "Voting Member"

An open letter to the "Voting Member" of Barony Place Neighborhood. Good morning, Billie, If you and/or an Alternate attended last night's board of directors meeting, will you please send out a recap of the meeting to Ann Stirlen and me (and to all the homeowners and residents in Barony Place)? About a dozen homeowners from throughout The Summit showed up for the board meeting  at the church  last night, only to learn from one person that it had been switched to Zoom, which allowed the board to meet in secret. Many of them had not received the email from the office that the board was (illegitimately) closing the meeting to homeowners. There are only about 1,800 (73%) email addresses of the 2,480 Members in the website database. I attempted to join the meeting on Zoom, as I am Attorney-in-Fact for Ann Stirlen, but I was not admitted to the meeting. Special Assessment Possible?

How would you feel about a $3,000 Special Assessment levied by the HOA against you and every other HOA Member (homeowner)? Article X, Section 4 in the CC&Rs allows this. Are you aware of that? Should the Board do everything possible to eliminate the possibility of such a Special Assessment? What is the Board doing that might just lead directly to such an Assessment? The HOA, by actions of the President (Justin Martin), the Treasurer (Vernell Butler, and the Safety Committee Chair (Dennis Rybicki) entered into a contact with the Richland County Sheriff's Department, effective February 1, 2023. They arranged for special patrols in the Summit at a cost of $48.00/hour. In the Special Duty Agreement is a Liability clause.
