HOA ends Special Duty Agreement with RCSD

Last February the Summit's HOA renewed the Special Duty Agreement with RCSD. That's the deal which, for $48.00, deputies spend time in the Summit after their normal duty hours and "keep us safe".

I quickly pointed out several problems with it.

1) The Agreement was not made in the legal name of the Association. Somebody was careless and submitted the Agreement in the name of "Summit HOA". That's a different business.

2) CAMS paid several invoices from RCSD, even though the Association was not a party to the contract. Through 6/30/2023, $7,752 was paid to RCSD.

3) The Treasurer executed the Agreement, not the President and the Secretary. The Board apparenty never addressed and approved entry into the Agreement.

4) The Liability Clause created a huge potential liability for the Association.

5) The Board apparently never had its attorney review the Agreement before it was signed.

6) The Board apparently never had its insurance company review the Agreement. The insurance company almost certainly would have raised the insurance premium for the added liability.

7) RCSD deputies could not enforce policies or regulations of the HOA.

In its private Zoom board meeting on September 5, 2023, from which homeowners were excluded, the Safety Committee report read, in part,

"Also, in the (pre-board) meeting we took a good overview of signal 30 extra duty patrol that is being paid for, did research, and could not find that they have cause an affect [sic] where Crime has gone done [sic], a notion [sic] was made to have signal 30 removed effective August 30, 2023, contract was not renewed."

I swear; that's exactly how that portion of the Safety Report reads. Are the errors in the original report or was the report re-typed for the Minutes? Who wrote that report?Did the person pass Sixth Grade?

The Agreement wasn't "not renewed". It was canceled.

"signal 30" is Dennis Rybicki's pet term of the hiring of off-duty deputies. "signal 30" has no meaning here. Code 30 (or 10-30), in police lingo, means "Officer needs help - Emergency" or "Homicide by shooting". It means different things in different departments.

Will any Board member read the Minutes and insist on corrections before the Minutes are approved at the October meeting? Bets, anyone?

And, for the people who think that decisions are not made in private, secret, pre-board meetings, that decision was apparently made on August 29, 2023, so that the Agreement could be canceled on August 30. There should be Minutes of the pre-board meetings, but they are never published. I wonder if they are ever even written.
